To become a member of SA Architecture Network, you must complete the membership application process. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your membership information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access
  • Meet any professional qualifications or eligibility criteria for your membership tier

4.2 Membership Approval

We reserve the right to approve or reject any membership application at our sole discretion. Membership is subject to verification of credentials and compliance with our membership standards.

4.3 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorised use of your account.

5. Membership Types and Benefits

5.1 Membership Tiers

SA Architecture Network offers different membership tiers, which may include:

  • Associate Membership
  • Professional Membership
  • Mentor & Advisor Membership

Each tier provides specific benefits, access levels, and privileges as outlined in our membership information.

5.2 Membership Benefits

Members may receive benefits including but not limited to:

  • Access to exclusive networking events
  • Professional development resources
  • Industry publications and updates
  • Directory listing and profile visibility
  • Continuing professional development (CPD) opportunities
  • Discounts on events and services

5.3 Membership Responsibilities

As a member, you agree to:

  • Uphold professional standards and ethics
  • Maintain current professional registrations and qualifications (where applicable)
  • Participate in the network in a respectful and constructive manner
  • Comply with any code of conduct or professional standards
  • Keep your membership information current and accurate

6. Use of Services

6.1 Permitted Use

You may use our Services for lawful purposes in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit harmful or malicious code
  • Interfere with the proper functioning of our Services
  • Harass, abuse, or harm SA Architecture Network members, SA clients or SA Academy users
  • Collect member information without consent
  • Impersonate any person or entity
  • Use membership for unauthorised commercial solicitation

6.2 Member Directory

Members may be listed in our member directory. You consent to the display of your professional information as provided in your membership profile, subject to privacy policy.

6.3 Professional Services

Any architecture or design services obtained through connections made via our network are subject to separate professional service agreements between the parties. SA Architecture Network facilitates professional connections but is not a party to, and is not responsible for, the quality or outcome of professional services rendered between members.

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by SA Architecture Network and protected by copyright, trademark, and other intellectual property laws.

6.2 Member Content

You retain ownership of content you submit to our Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting our Services and membership network.

6.3 SA Academy Educational Content

All educational materials, courses, tutorials, templates, and resources provided through SA Academy remain the intellectual property of SA Academy. Members are granted a limited, non-transferable license to access and use SA Academy content for personal professional development only. Members may not reproduce, distribute, sell, or commercially exploit SA Academy content without express written permission.

6.4 Member Testimonials

We may use member testimonials, success stories, and feedback for promotional purposes unless you opt out of such use.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. As a member, you acknowledge that certain professional information may be shared within the network directory.

8. Membership Fees and Payment

8.1 Membership Dues

Membership requires payment of annual or recurring membership fees as specified for your membership tier. All fees are stated in Australian Dollars (AUD) unless otherwise specified.

8.2 Payment Terms

  • Membership fees must be paid in advance
  • Fees are non-refundable except as required by law or at our discretion
  • We reserve the right to modify membership fees with 60 days’ notice to current members
  • Failure to pay membership dues may result in suspension or termination of membership
  • Renewals are automatic unless you cancel before the renewal date

8.3 Additional Service Fees

Certain events, courses, or additional services may require separate fees beyond standard membership dues.

8.4 Refund Policy

Membership fees are non-refundable. However, we may provide pro-rata refunds in exceptional circumstances at our sole discretion.

9. Disclaimers and Limitations of Liability

9.1 Service “As Is”

Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Professional Advice

Information provided through our Services is for general informational purposes only and does not constitute professional architectural, legal, or financial advice. You should consult with qualified professionals for specific advice.

9.3 Limitation of Liability

To the maximum extent permitted by law, SA Architecture Network shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Indemnification

You agree to indemnify, defend, and hold harmless SA Architecture Network, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our Services or violation of these Terms.

11. Membership Suspension and Termination

11.1 Termination by Member

You may terminate your membership at any time by providing written notice. Termination will be effective at the end of your current membership period. Membership fees already paid are non-refundable unless otherwise stated.

11.2 Suspension or Termination by SA Architecture Network

We reserve the right to suspend or terminate your membership at any time for:

  • Violation of these Terms and Conditions
  • Non-payment of membership fees
  • Breach of professional standards or code of conduct
  • Provision of false or misleading information
  • Conduct that brings the network into disrepute
  • Any other reason at our reasonable discretion

11.3 Immediate Termination

We may immediately terminate membership without notice in cases of serious misconduct, illegal activity, or significant breach of these Terms.

11.4 Effect of Termination

Upon termination of membership:

  • Your access to member-only Services will immediately cease
  • Your profile will be removed from the member directory
  • You must cease representing yourself as a member of SA Architecture Network
  • Any outstanding fees remain payable
  • Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability

11.5 Reinstatement

Former members may apply for reinstatement subject to our approval and payment of applicable fees.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of South Australia, Australia, without regard to conflict of law principles.

12.2 Dispute Resolution Process

In the event of a dispute, the parties agree to first attempt to resolve the matter through good faith negotiations. If unsuccessful, disputes may be resolved through mediation before pursuing litigation.

12.3 Jurisdiction

Any legal proceedings shall be brought exclusively in the courts of Victoria, and you consent to the jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new “Last Updated” date. Your continued use of our Services after changes constitute acceptance of the modified Terms.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and SA Architecture Network regarding our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
